What Happens After My Breath Test?

In DUI defense cases, one of the most critical factors is the evidence obtained through breath tests. In recent years, law enforcement authorities have become more reliant on breathalyzer tests to establish guilt in these matters. This is cost-effective for police departments but can be problematic for suspected drunk drivers who are subjected to the tests.

Experienced Defense Against Drunk Driving Charges

I am Chickasaw County lawyer Gene Barton, known for more than 40 years as the “Bulldog of Mississippi.” I fight for my clients every step of the way to protect their rights by challenging evidence obtained through breathalyzers.

If you are facing DUI charges, you have a limited amount of time to protect your driving record and avoid a license suspension. You need an attorney on your side. Call 662-260-6646 now for a free initial consultation.

Note: I cannot defend criminal cases in the city where I am a prosecutor, which is Okolona. I can defend cases in greater Chickasaw County and surrounding counties throughout Mississippi, as well as in federal court.

The Purpose Of Breathalyzer Tests

The object of breathalyzer tests is to determine the blood alcohol content (BAC) of the suspected drunk driver. This can be done through an analysis of the vapor using a wet chemical method or by using infrared spectroscopic analysis.

Common Breathalyzer Testing Equipment

There are a number of common breath analysis machines in use today throughout the country, including the Intoxilyzer 5000, Intoxilyzer 4011 and the BAC Datamaster. Some localities still use more dated equipment such as the Breathalyzer 900 or Breathalyzer 990A.

Breathalyzer Maintenance

Routine maintenance is required to maintain reliable performance of breath analysis machines. Failure to maintain them can result in inaccurate results. Serious questions have been and continue to be raised in the courts as to just how reliable these machines are and whether they should be considered valid evidence in DUI cases.

Contact Me If You Are Facing Drunk Driving Charges

I have the experience and skill to effectively challenge breathalyzer evidence in DUI cases and will not hesitate to fight for your rights in court. To learn more about how I can help you defend your rights after a DUI arrest, contact my law firm today for a free initial consultation.
